How can you get caught. Caught from doing what.

Well having custom fw and modifying (aka flashing) is illegal and they may send it back if they find out cuase it goes under modification not performed by SONY.

I think he means if Sony found out you were running homebrew on the system. nothing they can do about it anyway.

I bricked one of my white PSPs using cIntro a few days ago. Right now, I'm thinking if I should get a modchip or just be stupid and put it out with the trash.

If you send it to them. They just get another PSP they can update to a higher firmware

I know somebody who sent his PSP with a messed up UMD drive to Sony and they sent him back a 1.0 (which he then upgraded to 1.5) Yesterday I bricked a PSP trying to downgrade it, but I returned it so it's ok.

As for bricking your PSP from xflash, so what? Just recover it, and if you don't have 3.03 OE you are behind. I semi bricked my own PSP from the version changer but recovered it.
