    Datel, maker of console peripherals, has filed a lawsuit against Microsoft over its move to block third-party memory units from working on Xbox 360s.

    The company said Microsoft's decision to block all unauthorized memory units through a system update - allegedly to prevent cheating - "unfairly favours its own Xbox 360 accessories".

    "Microsoft's purpose in disabling Datel's memory cards is to prevent consumers from choosing a Datel product that offers far better value for the price," reads the Datel complaint (via Tech Flash. "There is no benefit to consumers from Microsoft's decision to target and disable Datel's memory cards.

    "To the contrary, Microsoft's actions will leave approximately 50,000 consumers with useless memory cards and (without the ability to access their data on the cards), forestall innovation, and deprive future consumers of the benefits of competition."
    The suit seeks an injunction to prevent Microsoft from "disabling or erecting technological barriers to Datel accessories," in current and future game consoles.

    Speaking to CVG last month, the firm said that it was "disappointed" with MS' move, and that it believes "Max Memory offers a good value, high capacity, alternative to the official Memory Unit."

    At the moment a 512MB memory unit from Microsoft goes for £24.99, while a 2GB model from Datel can be bought for just a few pounds more, so we make them right. ...

    At least 2 million Xbox Live users have logged into their Facebook accounts through Xbox 360 since it launched last week, Microsoft claims. That's 10% of all Xbox Live users.

    The impressive statistics, given to Cnet by Microsoft spokesman David Dennis, show that while Facebook has had the biggest adoption out of Xbox Live's new social network features, in its first 24 hours more than half a million accounts were created for Last.FM.

    Xbox Live users have streamed 120 million minutes of music through the service, says Microsoft, while a massive 1.7 million Xbox live users have watched a video on Zune Marketplace.

    The statistics don't address how many Xbox Live users have used the Xbox Live's Twitter feature, except to say that there have been "tweets from nearly every market where we have Xbox Live." ...

    Sony will compensate anybody who bought a faulty launch version of Assassin's Creed: Bloodlines from the PlayStation Store.

    "Yes, there was an issue with the original download," a Sony spokesperson told Eurogamer. "It was pulled from the store and we are issuing replacement codes for those people who purchased the content before 12pm GMT on 20th November."
    Problems arose after Sony speedily replaced the broken file, as the PlayStation Store treated the working copy as a new game and demanded disgruntled owners pay another £24.99.

    One Eurogamer reader wrote to tell us Sony had shut up shop and not responded to phone calls, emails or updated the European blog to explain what was going on.

    Ubisoft, for its part, said this is "a customer service issue of Sony". ...

    Not only can this 2007 model UX490 quad-boot into OS X, Windows 7, XP Pro, and Vista Business, but its specs have been overhauled. A voice-capable HSPA modem has been added, plus a faster CPU and larger solid-state hard disk.

    The original 1.2GHz Core 2 Solo U2200 processor (which was soldered in place) has been swapped with a 1.33GHz Core 2 Duo overclocked to 1.438GHz. And the 48GB SSD is replaced with a fast RunCore ProIV 128GB SSD. Amazingly, the battery life is said to be pretty much the same.

    It's a pretty involved mod, but it's a hackintosh I'd definitely like to take for a spin. That 4.5-inch touchscreen doesn't look too bad, either. ...

    Wii hardware sales jumped 60 per cent last week – as the black version of the console helped stimulate fresh interest in time for Christmas.

    The Black Wii, which launched a fortnight ago on Friday, November 6th, helped the console become the best performing home system of the week, according to Nintendo.

    Koch Media – has told MCV that it has been working “round the clock” to deal with increased demand.

    “Of course it would be wrong to attribute all of this to Black Wii as we’re all starting to see a natural peak season uplift on all hardware,” said senior Nintendo product manager Rob Lowe.

    “But we have been really pleased with Wii’s performance over the last couple of weeks and the new Black Wii has certainly contributed to that. In fact Black hardware sales have doubled week-on-week.”
    Nintendo is hoping to avoid any stock troubles as demand increases. Lowe added: “We’re bringing in a decent supply of stock and hopefully retail will find it in plentiful supply this Christmas – although consumer reaction to the new colour might suddenly change that position. It is a limited edition version of the console so currently we only have plans for it to be available in 2009.”

    Koch Media boss Craig McNicol added: “We are working around the clock this Q4, opening each weekend to take in deliveries to support yet another strong Nintendo Christmas. Nindie.com continues to be the only place to offer a fair allocation of stock to the independent channel.

    "We allocate our stock based on the market share that our customers have built up with Nindie on first party Nintendo purchases in the past quarter. Loyalty gets paid back with fairness.”

    Microsoft Corp. has responded to a possible class-action lawsuit over banning up to one million Xbox 360 consoles from accessing its online gaming service, arguing the company is well within its rights to ban users from Xbox Live.

    U.S. law firm Abington IP recently announced on its website that it's considering filing a class-action lawsuit over Microsoft's worldwide crackdown on modified Xbox 360 consoles by booting them from the Xbox Live online network. The firm is asking those interested in joining the suit to contact them.

    Microsoft "conveniently" waited until after the launch of two of Xbox 360's biggest holiday titles before banning up to one million consoles from accessing its online gaming service, the firm argued.

    A spokesperson from Microsoft reacted to the possible lawsuit on Friday. "Piracy is illegal and modifying an Xbox 360 is a violation of the Xbox Live Terms of Use. Microsoft is well within its legal rights to ban these users from Xbox Live."

    The number of bans has not been released by Microsoft, but some media reports suggest between 600,000 and one million consoles were banned.

    The law firm is asking Xbox Live subscribers who were not refunded for the time left on their subscription to participate in the possible class action.

    A 12-month subscription to the service, which allows players to access the online marketplace and play online with other subscribers, costs about $60. More than 20 million people are members of Xbox Live.

    "Although modification of Xbox consoles is ‘arguably' against the terms of use for Xbox/Xbox Live, Microsoft conveniently timed the Xbox console ban to coincide with the release of the new Call of Duty: Modern Warfare 2 game and less than two months after the release of the very popular Halo: ODST game," argued Abington IP, which specializes in consumer class action lawsuits.
    Abington IP said the timing might have resulted in more Xbox Live subscription revenues for Microsoft than it would have generated had the console bans taken place before the releases. The firm also argued sales of Modern Warfare 2 -- which launched Nov. 10 and set a new sales record by grossing about $550-million over the first five days of sales -- would have been hampered by the bans. Both Halo: ODST and Modern Warfare 2 have very popular multiplayer modes.

    "As an aside, piracy is a legitimate concern for Microsoft and other content producers," said Abington IP. "However . . . Microsoft has chosen to use one of the most indiscriminate ‘weapons' in its arsenal in an effort to combat piracy."

    The U.S. Air Force is looking to buy 2,200 Sony PlayStation 3 game consoles to built out a research supercomputer, according to an document posted on the federal government's procurement Web site.

    The PlayStation 3s will be used at the Air Force Research Laboratory's information directorate in Rome, N.Y., where they will be added to an existing cluster of 336 PlayStation 3s being used to conduct supercomputing research.

    The Air Force will use the system to "to determine the best fit for implementation of various applications," including commercial and internally developed software specific to the PS3's Cell Broadband Engine processor architecture. The research will help the Air Force decide where Cell Broadband Engine processor-derived hardware and software could be used in military systems.

    The Air Force has used the cluster to test a method of processing multiple radar images into higher resolution composite images (known as synthetic aperture radar image formation), high-def video processing, and "neuromorphic computing," or building computers with brain-like properties.

    The PlayStation 3's eight-processor Cell powers other supercomputers, including the world's second-fastest, IBM's RoadRunner, at Los Alamos National Laboratory.

    In June, the Department of Defense awarded $2 million for this research under its High Performance Computing Modernization Program, the DOD's arm for supercomputing research, development, test, and evaluation. That follows an initial investment of $118,000 on the original cluster.

    Before it won the research award in 2008, the information directorate's advanced computing architectures team considered alternative configurations and the possibility of a hybrid system, but found multicore Xeon servers slower and more expensive than PS3s, and GPGPUs to be slower in some important types of calculations.

    The Air Force Research Laboratory's information directorate spends about $700 million annually on R&D, in areas such as collaboration, networking, cybersecurity, and computer modeling. ...

    Konami has alerted us to an upcoming and free bout of DLC for the Wii version of Pro Evolution Soccer 2010.

    Simply, the update brings all player stats and data in-line with the real world. So, imagine a crazy universe where Robin Van Persie had been injured during international duty - if that was the case the game would reflect it. You might even find he was out of the Arsenal squad for six weeks! Just imagine.

    We expect Konami will issue a few of these data refreshers as the season goes on.

    Pro Evolution Soccer 2010 is out on Wii this Friday, and we'll be discussing its pros and cons in a separate review. Maybe on Wii the match between Konami's and EA's game of football isn't so one-sided. ...

    Konami is promoting Metal Gear Online with a monthly series of Survival Challenge events. Starting a week on Saturday - 28th November - players will be awarded Reward Points based on the length of their team's winning streak in Survival games over a 24-hour period.

    The next events will be on 26th December, 23rd January, and 27th February. To be eligible you just need to join a Survival lobby in the PS3 multiplayer shooter and play at least one game during the 24 hours; numbers will be capped at around 3000 players. You'll get a Regain in-game T-shirt to prove you turned up on each day, and a Regain hat if you make all four.
