Well known 3DS Hackers Yellows8 & Neimod have now breached the security of the 3DS and gotten into full Kernal Mode access (arm9 & arm11). The exploit is on an Unmodified Nintendo 3DS via a Game Exploit on an unknown Card Game (although shouldnt be too hard to find out which. As of yet the exploit though unreleased is working perfectly.
