Sega and Gearbox have each dismissed the proposed class action lawsuit over the alleged false advertising of Aliens: Colonial Marines.We reported yesterday that a California law firm has filed a lawsuit against Sega and Gearbox, claiming that the publisher and developer falsely advertised the title through trade show and press demos. It is seeking damages on behalf of game players that pre-ordered the game, or bought it on the day of release. Both Sega and Gearbox have now responded.“Sega cannot comment on specifics of ongoing litigation, but we are confident that the lawsuit is without merit and we will defend it vigorously,” Sega told Kotaku.A Gearbox representative told the same site: “Attempting to wring a class action lawsuit out of a demonstration is beyond meritless. We continue to support the game, and will defend the rights of entertainers to share their works-in-progress without fear of frivolous litigation.”
