Originally appearing in Australia overnight, the demo has now been downloaded - and played - by people all over the world. People who care not for the fact the demo wasn't supposed to be out until February 4; it's out now, servers are working, so they're going at it.
If you're worried about it being locked down by EA and/or Microsoft, don't sweat it: the early release has the official blessing of DICE, (http://twitter.com/OfficialBFBC2/status/8317834065) so have at it.
