The High Court ruling that confirmed DS R4 piracy cards are illegal will get developers excited about
the DS again.

Last month, a UK specialist IP court helped solidify the case against the cards, encouraging some rogue retailers to confess to being guilty of IP theft.

The platform holder hopes this will deliver renewed confidence in the handheld amongst developers and publishers that scaled down work on the platform as piracy became widespread.


“To get this judgement from a UK specialist IP civil court is an important step in the right direction,” Nintendo’s European anti-piracy counsel Neil Boyd told MCV.

“It is important to Nintendo – but also for the developers. Hopefully it will give them the encouragement and confidence to continue to develop the best games for Nintendo platforms.”

Piracy has been a significant problem on DS over recent years. Back in February, Take-Two CEO Ben Feder blamed weak sales of GTA: Chinatown Wars on the R4.
Boyd also said the ruling will help protect the upcoming 3DS when it launches.


“Only time will tell if the 3DS will be hacked,” he added. “But in terms of security, and preventing people getting around those security measures, I think this case gives us a good, solid legal foundation. What comes ahead of us is pure speculation, but it gives us a good basis for future security threats.”

It always has to be piracy that's to blame.
Never because far to many of the games are either :-
- Crappy

- Price

- Repeats " how many Pokemon games? " still using the same old and tired formula.

It wont ever because the world is facing a huge slump in all the markets.

Every PC ever made can to some degree copy games, are they going to make them all Illegal now?.

Shall we ban all radios just because they can receive pirate radio stations.

Ban cars because the can all be used for crime.

No its never going to happen, but as soon as the word " COPYRIGHT " is heard all sense goes out of the window.

I have said it before and i will keep on saying it, most of the copied games would never have been bought, people download them only because they are FREE.

Now go take a look at Nintendo's profits and ask yourself, who exactly is getting the bad deal here.

Nintendo still makes plenty of profit because people have been buying DS consoles _because_ they've heard about flashcarts from one of their son's schoolmates, and plus Nintendo themselves have actually provided some of the best games on the DS too. It's not a conspiracy.


most of the copied games would never have been boughtThis old argument is assuming people are honest, which they are not. GTA-CW was not a bad DS game by any means, just many kids say "doesn't look like the X-Box 360 GTA4 = therefore it's crap = I can pirate and still go to Heaven."

In my experience, pirates will always find an excuse. I also blame many of the publishers and developers that dress up yet another Bejeweled clone to look like something completely different, for whatever makes the game sell as opposed to an actual enjoyable game, but piracy can never fix that, it's a perpetual bad situation. The more games like this are made, the more it makes players want to pirate, not for the sake of piracy, but for the sake of only giving their money to those behind the good games. Unfortunately, this is one of those honour systems that human beings _will_always_ abuse.

I feel sorry for those R4 owners who are amateur developers. They are the real victims. There also should be a lot of blame to the flashcart communities out there that encourage piracy instead of development. Infact, I really don't know many flashcart communities that aren't a bunch of elitist morons who know way more about piracy of yet-to-even-be-released games than they would ever know about good honest game development.
