Yea, I don't see how he can't win, but I'm not a legal expert. I would think the precedent set by the DMCA for iPhone jailbreaks would apply here as well. The only difference is the impact in dollars that piracy has on the system. And I don't think that should be allowed to be a consideration. But our legal system is all jacked up, it's anyone's guess who will win really. Sony could draw this out for years, but I don't think they will, I think they are looking for a quick and decisive victory to deter any other would-be hackers and distributors of the code.
