In response to Microsoft's attempt to dismiss Apple's 'App Store' trademark application (http://www.tuaw.com/2011/01/12/microsoft-files-objection-to-apples-app-store-trademark-appli/), Apple references Microsoft's claim to the Windows trademark (http://www.techflash.com/seattle/2011/03/apple-fights-for-app-store-trademark.html). 'Having itself faced a decades-long genericness challenge to its claimed WINDOWS mark, Microsoft should be well aware that the focus in evaluating genericness is on the mark as a whole and requires a fact-intensive assessment of the primary significance of the term to a substantial majority of the relevant public.'"http://apple.slashdot.org/story/11/03/02/050202/If-App-Stores-Trademark-Is-Generic-So-Is-Windows
