A US appeals court has overturned an injunction on the sale ofSamsung's Galaxy Nexus smartphone.
In making the ruling, the Appeals Court said that Judge Koh had abused her discretion in ordering the injunction on the device.
The move is a blow to Apple in its battle against Android.
The Samsung Galaxy Nexus wasn't part of the trial that ended with a $ (http://www.mobile-ent.biz/news/read/samsung-must-pay-apple-1bn-in-damages/019153)1.05 billion verdict (http://www.mobile-ent.biz/news/read/samsung-must-pay-apple-1bn-in-damages/019153) in favour of Apple - Koh issued the injunction against the Galaxy Nexus prior to the trial.
Koh agreed with Apple that the phone infringed on Apple's patent for a function that searches the net and a device's internal memory at the same time. However the Appeals Court said it reversed the decision because Koh had abused her discretion and because Apple could not prove that consumers were buying the Nexus because of the infringing technology.
