We'd been disappointed to find that iOS 4.2 only brought AirPlay video support to built-in Apple apps on the iPhone and iPad, but it looks like that's changing soon -- Apple just posted up the first iOS 4.3 beta, which allows devs to send video from apps or websites to an Apple TV. There's also a new beta of the Apple TV software for testing it out -- it doesn't have any version notes, so we don't know if it offers any additional features as well. One thing we're not seeing explicitly listed is any mention of mobile hotspot functionality -- and considering the Verizon iPhones we saw were running iOS 4.2.5, we've got a feeling everything still hasn't been merged up. We'll let you know if we find anything else -- stay tuned.

Update: What do you know -- personal hotspot is indeed in there, although it needs to be enabled on the carrier side to work. We're also told the iPad's gained some additional multitouch gestures, so it's quite a feature-party. We'll keep you updated as we learn more.

Update 2: Oh snap -- the iPad's side switch can now be set back to being an orientation lock! Praise be. Screenshot after the break. Thanks, Matt!

Update 3: We're also seeing a new FaceTime icon, which is nice, and 9to5 Mac noticed that the iPad now supports fullscreen iAd banners, which is less nice.

Sony Computer Entertainment America is suing notorious hacker George Hotz and more than 100 others, including members of fail0verflow, for publishing root key details and cracks for the PlayStation 3.

Last year Hotz published an exploit for the PlayStation 3, but it wasn't until this year that hackers fail0verflow released information on how to completely circumvent security measures for the system, leaving it wide open to exploitation.

The hardware manufacturer alleges the defendants "circumvented effective technological protection measures" for the PlayStation 3 and other copyrighted works, and "trafficked in circumvention technology, products, services, methods, codes, software tools, devices, including but not limited to the Elliptic Curve Digital Signature Algorithm Keys, encryption and/or decryption keys, dePKG firmware decrypter program, Signing Tools, 3.55 Firmware Jailbreak, and/or any other technologies that enable unauthorized access to and/or copying of PS3 Systems and other copyrighted works."

Sony alleges the defendants have violated the Digital Millenium Copyright Act, the Computer Fraud and Abuse Act, the Copyright Act and related state and common laws covered by the California Comprehensive Computer Data Access and Fraud Act, according to legal filings published by Hotz.

Sony is seeking a Temporary Restraining Order against Hotz, along with an Order to Show Cause and Order of Impoundment claiming "it will suffer irreparable harm unless Defendant Hotz's violations are enjoined."

The restraining order would stop Hotz from trafficking any circumvention technology or providing any links to websites offering circumvention technology, and from accessing the PlayStation 3 system in order to obtain code or information, or publishing any code or instructions or assisting others to do so.

The impoundment order gives Hotz 10 days to deliver any hardware or software to Sony's legal team which store circumvention technology.

At the time of writing details of the PS3 Jailbreak and a video from Hotz were still available freely online.

The man behind ancient arcade classic Pong reckons that studios today are too afraid to take risks, thanks to the huge budgets involved in modern game development.

Speaking with VentureBeat about how the industry has grown since he made one of the first ever videogames back in 1972, Atari co-founder and Pong programmer Al Alcorn said "It wasn't my intention – I'm surprised as the next guy.

"I think it was a lot more fun when it was just a little thing and there was no expectations," he explained.

"If you look at our games – the earlier games – they were all really wildly different. We tried all kinds of things. It was a great time to experiment. Now, the money is so big, we're afraid to take risks. We took a lot of risks and we had a lot of fun doing it."
When asked if he had any advice for the current generation of developers, he called on them to be a little braver and resist the temptation to rehash existing concepts.

"Boy, I've not been in the videogame business for a long time but I think just in general you've got to take some risks to do new things. We're seeing some of it slowly with the 3D Kinect thing and the Wii.

"If you're trying to compete with what somebody else has already done it's really, really risky to [try and] do better than that. I think people are better off trying a new kind of game, and maybe they'll get lucky."
Allcorn left Atari in 1981 to become a tech consultant in Silicon Valley. ...

Microsoft wants the US Patent and Trademark Office to reject Apple's application for the name 'App Store', arguing that the term is generic and one the iPhone maker's competitors should also be able to use.

Yahoo reports that Apple's trademark application, which was filed in 2008, relates to goods and services including "retail store services featuring computer software provided via the internet and other computer and electronic communication networks".

In its motion, filed on Tuesday, Microsoft said: "'App store' is a generic name that Apple should not be permitted to usurp for its exclusive use. Competitors should be free to use 'app store' to identify their own stores and the services offered in conjunction with those stores."

While the term 'App Store' has become synonymous with Apple and its products, Microsoft and a number of other major players in the retail market also operate or are developing their own app stores.

Microsoft's Windows Phone 7 now plays home to 5,500 apps in its marketplace, more than 60 of which carry Xbox Live features. ...

The industry will finally find out what form the PSP2 will take at a press event in Tokyo on January 27th, trade sources have confirmed to MCV.

Claims emerging this morning about an impending reveal for the long-rumoured PSP2 are true.

Publishers were informed late last year of the plans, with some of Sony's biggest parties already at work on titles for the high-specced device.

The date of the reveal itself is just the beginning, however.

This Friday's copy of MCV magazine has some exclusive industry insight - some of which will come as a huge surprise. Check back for the full story on MCVuk.com. ...

A number of sites have gone live with pre-orders for the Nintendo 3DS, with a placeholder price of £299 having been put in place.

Eurogamer spotted the listings on The Hut, WHSmith, Best Buy and Woolworths. What the site didn't note, though, is that all of these portals are run from The Hut's centralised system, effectively meaning it's a single listing.

Other retailers are yet to go live with a price.

Play.com and Amazon are allowing visitors to register their interest while GAME and others simply have placeholder page in place.

Concrete launch details for the machine will be unveiled next Wednesday at Nintendo's Amsterdam event. MCV has been lead to believe that the console will arrive in the UK on or around March 25th with a shelf price of £200-£230. ...
