Cease and desist warnings sent to iPhone hacking resource, report claims

Apple has sparked a new legal battle against websites that facilitate illicit App Store downloads, a new report suggests.
The iPhone manufacturer is sending cease and desist letters to the owners of a popular iPhone hacking online resource.

The threats, according to a Cult of Mac report, have forced the hackers to “relocate many of its servers and implement more steps for its users to avoid legal ramifications”.
In response, the iPhone hacks group has apparently “implemented Captcha checks” that need to be passed before downloading cracked apps. It is said that this is to avoid the legal implications of hosting direct links to pirated software.
“Other piracy hosts have attempted to avoid the courtroom by also moving servers to regions outside of the United States,” the report added, with the costs involved apparently the reason why the hacking network has implemented display advertising.

Microsoft set out to explain the new 'refresh and reset' options of the upcoming Windows 8, offering the ability to reset back to a "good state" or the "factory state" when decommissioning or passing on a PC.
Describing the plans in a new post on the Building Windows 8 blog, Microsoft described how the "Reset your PC" version would remove all personal data, apps and settings while also reinstalling Windows 8.
A less nuclear option is the so-called "Refresh your PC" option which will retain personal data, OS/PC settings and Metro-style apps while also reinstalling Windows 8. It would seem that Microsoft will also remove traditional native Windows apps and not reinstall them.
"We do this for two reasons. First, in many cases there is a single desktop app that is causing the problems that lead to a need to perform this sort of maintenance, but identifying this root cause is not usually possible," wrote Windows team program manager Desmond Lee.
"And second, we do not want to inadvertently reinstall 'bad' apps that were installed unintentionally or that hitched a ride on something good but left no trace of how they were installed," Lee added.
The functionality can be accessed either from within Windows 8 or via Windows RE, the new recovery tool which is accessible prior to Windows loading. If even this fails to start, there's also a tool to create a bootable USB flash drive which can be used to run the Windows RE tool.
Microsoft also talked up the speed that Windows 8 manages to accomplish the refresh and reset options with a refresh taking a little over eight minutes and a 'quick' reset taking just six minutes on the Samsung developer preview laptop.

The astonishing rise of a form factor that's basically less than two years old.
The latest NPD DisplaySearch Quarterly Mobile PC Shipment and Forecast Report says there were 72.7 tablets shipped in 2011, against 285.4m units for mobile PCs.
This represents a shipment growth rate for tablets in 2011 of 256 per cent thanks to significantly competitive new devices in Q4’11, strong demand for iPads, and additional distribution channels.
Yet there was still growth in the mobile PC space too - just not as fast. Notebooks were expected to reach 187.5 million units, up 12 per cent year on year, while mini-note PC shipments were pegged at 25.2 million units.
    But the gap is closing.
By 2017, notebooks are forecast to reach 432 million units, and tablet shipments are projected to reach 383.3 million units. Ultrabooks, the very slim laptops evangelised by Intel, could be the form factor to watch.

YouGov’s Technology and Telecoms stats show that one in every 40 adults in the UK either received an e-reader as a Christmas present, or bought for them as a gift or as a present for themselves.
As with paper book purchasing in the UK, there is a slight bias towards females, with 61 per cent of Kindles received by women. 55 year olds were twice as likely as 18-24 year olds to receive one.
Marek Vaygelt, head of technology and telecoms consulting at YouGov said: “This is finally the year when the late-medieval technology of the printing press was challenged by a 21st Century, digital alternative.
"Amazon has done a remarkable job of selling the benefits of e-readers and the upside for the publishing industry is that it appears e-reader owners, at least in the early days, buy more e-books than the printed books they purchased before acquiring an e-reader.”
YouGov’s modelling also suggests that over 640,000 tablets were gifted to adults, 72 per cent of them Apple iPads with 60 per cent of the Apple products being gifted to women.

It's the only surefire way to buy your way into the British TV mainstream.
Numerous reports suggest that the two tech juggernauts are to join the next round of negotiations for live 2013-2016 Premier League TV rights when the tender goes out before the end of the season.
If they are serious about establishing Apple TV and Google TV respectively as genuine viewing options for the British public, this is the only way to go.
It's what Sky discovered nearly 20 years ago when it fiddled around with movies and US imports unsuccessfully, before locking up footy and beginning its journey into 10m UK homes.
Sky paid £1.6billion for its current package, which guarantees it five times more games than the 23 bagged by the other rights owner ESPN.
Other commentators, such as PaidContent, believe a deal is unlikely because Apple and Google are not broadcasters, but tech firms and it would be counter to their usual modus operandi.

    2. Android News

App store analyst Distimo made the claim for Android, and it's yet another reminder of the accelerating power of the Google OS. Don't forget that Google recently reported 10 billion app downloads, 200 million Android devices in user, and 550,000 more activated each day.
Distimo added that 68 per cent of Android Market apps are free. That will surprise few of us, given the historically clunky nature of the buying process (initially via Google Checkout). Does Google care? probably not, since advertising is in its DNA.
Of course, Android Market is still playing catch-up with iTunes, which required two fewer months to reach the 400,000 app milestone. The Apple store is now home to around 550,000 products.
Overall, the Android space is just messier than that of Apple, with less vigilance and control over what appears in the store. And don't forget that there are other portals through which to download apps including significant locations like Amazon.

Just bought a 3DS? A lot of people did over the Christmas break. How about some lovely 3DS Lite rumours, then? Yeah, thought you'd like it.
Japanese magazine Nikkei Trendy has speculated that Nintendo will release a thinner '3DS Lite' in 2012 to help expand the console's user base."To increase the 3DS's install base, there's a possibility for a lighter version that addresses the handheld's weak points, the thickness and the battery life," says the magazine, according to Kotaku translations.
This it puts under the header of 'Spring', placing the release of a revised 3DS at just a few months away.
Calm down though. The key word here is 'speculate' - the magazine isn't reporting a rumour from any given source, just taking an educated guess based on the current lay of the land and previous trends.
The original DS released in Japan in December 2004 and was followed less than a year-and-a-half later by the DS Lite in March 2006. 3DS launched in Japan in February 2011, and in EU and US in March.
So, given that timeline, we'd be buying thinner 3DS units in June. But Nintendo has already previously said that it built the 3DS to be "fully packed right from the start," and thus "we don't have any short-term plans for creating a more compact version of 3DS like we did with DS Lite."
    Take that as you will.

A next generation Xbox may be able to record TV direct to your console. This DVR - digital video recorder - technology was detailed in a freshly granted (27th December) Microsoft patent. The patent was filed in January 2007, hence the rather antiquated (and terribly scanned) accompanying drawings (you'll need a TIFF viewer for your browser to view them)."An integrated gaming and media experience is disclosed, including recording of content on a gaming console," the patent, via Kotaku, read."A digital video recorder (DVR) application running alongside a television client component allows users to record media content on the gaming console."The DVR application also integrates itself with the console menu. Once integrated, users can record media content while playing games."Alternatively, users can record content when the gaming console is turned off."The recorded content can include television programming, gaming experience (whether local or online), music, DVDs, and so on."When in the recording state, users can also switch between various other media modes, whether gaming, television, and so on."Microsoft is expected to announce its new Xbox this year. Two new machines are apparently planned: one a paired-down console that serves as a set-top portal for Kinect; the other a fully-featured next generation machine. The announcement may happen as soon as this month, at the CES electronics show in Las Vegas. This takes place from 10th to 13th January.

    2. Nintendo 3DS News

The Nintendo 3DS has "turned the corner" following a shaky launch and early price cut, so says games industry analyst Michael Pachter.Following news earlier this week that the system has passed the four million sales mark in the US faster than the Wii did, the Wedbush Morgan mouthpiece told Eurogamer that, though he was surprised the system didn't take off at its original pricepoint, sales are now well and truly back on track."It's very successful, but ran into a headwind given its relatively high price - which I incorrectly thought was the right price - and lack of third party software support," said Pachter."Now that we are seeing more first party titles at a lower price point, sales have increased. It's definitely turned the corner.""I was surprised that it sold so few at the $249 price point, and its sales to date are exactly what I originally forecasted at that price," he added.EEDAR VP Jesse Divnich agreed that Nintendo's handheld has ridden out the early storm, though added a note of caution for the future."With the strong rebound in 3DS sales, I think Nintendo is clear of the woods for now," he said."Going forward, however, we will closely be paying attention to software attach rates. Selling hardware is great, but it is only the first step. The health of any hardware is directly correlated to the amount of software consumers buy."The 3DS's slow start surprised us all, but once they announced the steep price cut we had little concerns that they would rebound," he added. "At such a great price, backed by strong first-party content, it shouldn't be of any surprise they were able to turn the corner."Screen Digest's Piers Harding-Rolls also warned the platform holder against complacency following its bumper festive period."2012 will be crucial for the platform, as its sales momentum will decide how third-party investment in content development will be prioritised," he said."We expect the 3DS to continue selling, but Nintendo faces an increasingly competitive landscape and the hurdle of convincing third-parties to invest in the platform."All three agreed that it's unlikely the system will manage to catch the DS's lifetime total, which currently sits at around 150 million worldwide."I think anything catching the Nintendo DS will be incredibly difficult," opined Divnich."The key to catching the Nintendo DS would be appealing to the ultra-casual consumers, those who originally bought the Nintendo DS for games like Brain Age and Sudoku, which are now prevalent and cheaper on other platforms - tablets and mobile."But I don't believe topping DS sales is Nintendo's goal for the 3DS. Their goal, however, is to create a sustainable and healthy third-party environment which, as I alluded to earlier, means having high software attach rates that are generally driven by the core audience."Pachter agreed that the rise of the smartphone makes emulating the phenomenal success of the DS a tall order."The emergence of smartphone games is eroding the casual market's support for dedicated gaming devices, and I'd guess that 30 per cent or more of DS sales were to casual gamers. That makes it tough to compete," he said."At the high end, we have renewed competition from Sony with PS Vita, so they should nibble away at the hard core, leaving Nintendo an addressable market for 3DS that is around 60 per cent as big as the addressable market for DS."When asked, in the run up to the Western launch of the Vita, what lessons Sony can take away from the 3DS's rollercoaster first 10 months on shelves, Harding-Rolls replied:"It's important to launch with a strong set of games, strong connectivity functionality, familiar social features and well integrated online platform, and at an aggressive price point."Under current economic conditions and taking into account competition from other types of portable/mobile devices, my own feeling is that PS Vita pricing will be the biggest sticking point for the platform in the post launch period months."Pachter echoed those concerns over the Vita's £229 price tag."Sony is probably learning the hard way that pricing handhelds at the same level as the company's core console makes it hard to gain traction," he said."The 3DS tried and failed, and PS Vita is trying the same thing. We'll see if it works this time."My bet is that Sony will NOT lower the price right away - as Nintendo did - mostly because the 3DS had a pretty healthy profit margin at $249, and I think that the Vita is selling for only slightly above its cost to manufacture at that price."I don't see Sony taking losses to drive market share, so I don't expect them to cut price in 2012."
