    Digital delivery of games and gaming content is the inevitable future. But how prevalent is it in the present? The NPD Group estimate that, as it stands, digital downloads on a console are doing...OK.

    The retail tracking firm reckon that, of all Xbox Live "Gold" subscribers, 18% of them "regularly download from Xbox Live Arcade". When it comes to the PlayStation Network, things aren't quite as big, as only an estimated 10% of account holders "regularly buy digitally from Sony's PlayStation Network".

    It's important to note that this survey isn't counting somebody who bought a single copy of Street Fighter II over XBLA and left it at that. It's tracking those who buy, and buy often.

    The iPhone's App Store should feature a dedicated area for higher priced 'premium' content, according to the managing director of Dynamo Games.

    Such a feature would help more expensive content stand out in the busy marketplace, said the developer of Championship Manager 2009 Express, where a majority of titles sell for as a little as 59 pence.

    "I am sceptical about the different price points at the moment and feel there should definitely be a premium content area so that great games aren't lost because of their higher pricing," said Brian McNicoll, in a feature published today.

    "Lets face it, these type of games cost a lot more money to make so should be priced in a higher price bracket. People are willing to pay a fair amount of money for good content as has always been the case," claimed McNicoll.

    Championship Manager 2009 Express currently sells for GBP 3.49 on the App Store, at the higher end of the market, but McNicoll believes separating price points for games will help the iPhone business mature in the long-term.

    "If the platform is going to mature properly it cannot keep the current price points as it will not be viable for most games to make a profit with such a small price point, as it is only the lucky few that really can break through at that price range and make a lot of money."

    THQ's latest action title, Red Faction: Guerilla, is likely to face stiff competition from Activison's Prototype, with immediate price cuts on the title also an indication of poor sales.

    That's according to Cowen's Doug Creutz, who has lowered full year sales estimates for the title from 670,000 units to 500,000.

    "Although the 360 SKU of Red Faction: Guerilla remains in the top 10 sellers at both Amazon.com and Gamestop.com, we note that at Amazon the title is already garnering a USD 7.50 discount," wrote Creutz in his latest note to investors.

    "The PS3 SKU has fallen off the map at both sites. Activision Blizzard’s recent release Prototype is tracking far better on both the 360 and PS3, and we believe that title could be impacting Red Faction sales."

    Red Faction Guerilla entered the UK charts at number three this week, and follows impressive sales of the publishers UFC 2009 Undisputed title in the US and the UK.

    However, Creutz doesn't see any more strong releases from the publisher until 2010 and regardless of UFC success has left its rating of THQ shares as 'neutral'.

    "With UFC’s successful debut in the rearview mirror, and Red Faction apparently not gaining traction, THQ’s next important release will be Darksiders in January 2010, for which we continue to have cautious expectations. THQ has a very light holiday release slate, with no major releases aside from its annual WWE title," he added.

    EA's long-running, big-selling racing franchise Need for Speed has fallen on hard times in recent years. Which seems to have the mega-publisher on the front foot when it comes to their competition in the genre.

    Speaking (well, hating) at E3 last week, EA Europe's Patrick Soderlund had some rather unkind words for Need for Speed Shift's competition, saying:

    Let me tell you this. I think Split/Second looks great. I'm going to have a good time playing that. Blur to me is completely underwhelming. I don't understand what's up with that game to be honest. That's an official statement.

    Forza, I'm very confident we have a better game than them to be honest. Talking to the press, looking at the nominations, that's clear. So, I'm glad that they're confident but I'm as confident as they are.

    Hey, Patrick, why don't you tell us what you really think!

    The Nintendo DSi continued to be the best-selling games platform on the market in Japan - although its sales numbers this week could have easily seen it in fourth place at times last year.

    The handheld shifted 38,783 units, according to the latest data from Media Create for the week ending June 7, while the PlayStation Portable took second place on 29,070.

    The Wii held on to third place, with just 17,177, while the PlayStation 3 almost - incredibly - dropped below the 10,000 mark for the first time since launch.

    The Xbox 360 continued to track at fairly normal, low levels on 6625, followed by the DS Lite on 5664 and the PlayStation 2 on 4096.

    That list gave Nintendo just over 61,500 in total sales, compared to Sony's 43,000.

    A patent infringement lawsuit brought against Nintendo over parental control technology has been dismissed.

    According to a statement issued by Nintendo, Judge Manuel Real of the US District Court of Los Angeles granted Nintendo's motion for summary judgment of non-infringement on June 8.

    "We are very pleased with the Court's decision," said Nintendo of America senior vice president of legal and general counsel Rick Flamm.

    "Nintendo vigorously defends patent lawsuits. At the earliest stages of this case, Nintendo convinced the Court to dismiss this case as Guardian's patent had nothing to do with Nintendo's products."

    The patent in question - US Patent 4,930,158, "Selective video playing system" - was filed by Guardian Media in 1988. It is essentially technology created for the sake of parental control, allowing a user to block objectionable content from being accessible.

    Guardian's case against Nintendo is part of a larger suit against several companies that employ similar tech.

    Famitsu were right to sense more Tingle from Nintendo, because a teaser website for what must surely be a new game starring the company's most...eccentric little man has gone live.

    There's a brief cameo from Tingle, there's a fortune teller surrounded by skulls, and there's a section where you can write in and say what's on your mind. And that's it. A trailer will go live on the 18th, which is next Thursday.

    Could it be a sequel to Freshly-Picked Tingle's Rosy Rupeeland, a quirky but somewhat excellent RPG for the DS that was released in Japan and Europe, but not the US? Let's hope so!
