    The Serious Organised Crime Agency has closed down music website RnBXclusive.com and says those who used it could be fined and imprisoned.
    SOCA threatened users with an ‘unlimited’ fine and up to ten years imprisonment as it claimed the music site shared files that were ‘stolen from the artists’, resulting in losses of £15m per year to businesses and artists.
    A man has been arrested for fraud and is currently on bail pending enquiries. SOCA says the website obtained music – including unreleased tracks – by hacking.
    One other music site has already taken itself offline following the news, another is considering following suit and a third says it is now only dealing in ‘legal music files’ going forwards.
    The news comes after MegaUpload was shut by US piracy officials last month. The site’s owner Kim Dotcom was arrested.
    BBC reports a takedown notice on the R ‘n’ B website read: “The majority of music files that were available via this site were stolen from the artists.
    “If you have downloaded music using this website you may have committed a criminal offence which carries a maximum penalty of up to 10 years imprisonment and an unlimited fine under UK law.
    “SOCA has the capability to monitor and investigate you, and can inform your internet service provider of these infringements.”

    The High Street may be having a tough time, but the UK games market is still incredibly healthy, MCV research shows today.
    For the first time, we can reveal the true value of the UK games market, showing that consumers spent over £3bn on their hobby in 2011.
    It's proof that mobile, downloads and licensed toys are picking up the slack as other parts of the market soften.
    This impressive figure – £3.226bn to be precise - includes data on online, mobile, and merchandising.
    And it flies in the face of conventional wisdom which says market shrinkage hit during the last 12 months.
    In fact, when you combine data from some of the most respected research agencies, as we have below, you see game brands are more powerful than ever, even if the core High Street is facing some of its most challenging trading weeks.
    Add online revenues to boxed market data and it’s clear digital made up 30 per cent of a £2bn UK software market last year.
    2011 was also a watershed year for spin-off toys, DVDs and soundtracks, making £70m in revenue last year.

    Circulation figures for the UK's specialist games mags fell across the board, according to the latest figures from audit bureau ABC.
    Future's NGamer – recently rebranded to Nintendo Gamer – and Imagine's Play suffered the worst declines, losing more than a quarter of their readership compared to the same period last year. Official Xbox 360 Magazine and PC Gamer saw only minor dips, dropping by around 2,000 readers each.
    Interestingly, the Moshi Monsters magazine that launched last year outperformed all games magazines with a circulation of over 143,000.
    These figures do not include digital editions made available by Apple's Newsstand and other online marketplaces. In fact, when you take these into account Edge's circulation comes in at 26,626, showing only a five per cent drop rather than 12.
    Edge was actually the 15th highest-selling magazine across all digital products, with a circulation of 2,183. Three other magazines made it into the Top 72 digital magazines ABC listed: PSM 3 with 407 readers, PC gamer with 379 and Xbox World 360 with 244.
    However, it is important to note that ABC's digital figures are a monthly average taken for the whole of 2011 – Future's magazines have only been on the Apple store for three months, so their monthly readerships are actually higher than listed.

    Sales of the PlayStation Vita in Japan fell again this week as it was once again overtaken by its predecessor, the PSP.
    According to data from Media Create, published by Andriasang, the Vita took fourth place in the hardware chart with sales of 13,939 units - significantly down from the prior week's total of 17,141.
    Second and third places were occupied by the PlayStation 3 and PSP respectively, but the 3DS sold more units than all of the Sony platforms combined: 67,558, slightly down from the previous week's total of 75,018.
    Konami's new Suikoden game for PSP debuted in first place in the software chart with sales of 61,784. The critically admired Gravity Daze, a new release for PlayStation Vita, came in second, selling 43,462 units.

    Three of Australia's leading retailers will not stock the PlayStation Vita at launch, Kotaku reports.
    Target, Big W and K-Mart are all backing away from Sony's handheld, though Target and Big W confirmed via e-mail that they would consider stocking the product "at a later date."
    However, K-Mart stated that it has no plans to sell the Vita at all, dictated by a broader to strategy to move away from expensive items and towards cheaper products.
    As a result, the Vita will be chiefly available through specialist stores, and there is concern that consumers looking for a more competitive price from department stores will be frustrated.
    However, Sony is resolute that it fits with an underlying strategy to aim the Vita at a core audience.
    "For the launch of PlayStation Vita in Australia, with the specific target market being the active gamer, we have chosen to launch the console with a focused retail channel strategy across national specialist game and specialist technology retailers," Sony said in a statement.
    "There is a long term vision for our revolutionary new hand-held platform, in the same way we had a long term vision for PS3, and anticipate that in line with this we will broaden channel distribution in the future."
    With a week to go until launch, Sony has also dropped the retail price of the 3G Vita by $30 [Australian] to $419.95. The Wi-fi Vita will remain at $349.95.

    The University of Colorado at Boulder has been granted a $1.5 million research bursary to develop educational games designed to engage students in computer sciences.
    The money comes from the National Science Foundation and will fund an evolution of the iDreams program - which uses game programming to encourage students to produce models of STEM (Science, technology, engineering and maths) based phenomena.
    That program eventually included 100 teaching staff and over 8000 pupils, spreading to Alaska, Ohio, Oregon, South Dakota, Tennessee, Texas and Wyoming after being founded in Colorado.
    The team behind the iDreams program will be the recipient of the new funding and will implement the new methodology in the university's teaching.

    Ubisoft has confirmed the ongoing development of Assassin's Creed III, which is set for release on October 30.

    Host platforms weren’t announced, but the game is expected to launch on Xbox 360, PS3, PC and possibly Wii U. It will be the fifth core series entry in a franchise that has sold over 30 million units since the original debuted in November 2007.

    The title was announced byUbisoft CEO Yves Guillemot during a third quarter conference call with investors. He said the “fabulous” looking project has been in development for three years and that Ubisoft is investing more money in the game than it has in any other series entry to date, IGN reports.

    "Assassin's Creed 3 is the true next generation of both theAssassin's Creed brand and interactive entertainment/storytelling in general," Guillemot added, according to Joystiq.

    While no further details have officially been announced, CVGrecently reported that the game is set to feature a new protagonist and be set during the American Revolution.

    Earlier today, Ubisoft also announced a September 7 release date for Far Cry 3.

    The size of save files was not the cause of framerate issues affecting PS3 players of The Elder Scrolls V: Skryim, Bethesda claims.
    Speaking to Kotaku, chief game designer Todd Howard said that the problem, which reduced PS3 framerates to single figures in places and was finally patched last week, was in fact far more complicated in nature.
    "The way our dynamic stuff and scripting works, it's obvious it gets in situations where it taxes the PS3," he said. "And we felt we had a lot of it under control. But for certain users it literally depends on how they play the game, varied over a hundred hours and literally what spells they use.
    "No it's not [connected to save files]. That's the common misconception. It's literally the things you've done in what order and what's running. Some of the things are literally what spells do you have hot-keyed? Because, as you switch them, they handle memory differently."
    Howard claims that the problem was largely fixed with the 1.2 update, released in November, though there are plenty of PS3 players who would dispute that. Bethesda asked those still having problems to send them their save files for analysis. Patch 1.4, released last week, appears to have finally taken care of the problem for the vast majority of players.
    "Now that we've been through this, we're not naive enough to say we've seen everything, because we have to assume we haven't," Howard said. "There are still going to be some people who have to come back to us and say: 'Okay, my situation is this.' Send us your save game. We literally need to look at what you have running.
    "We [had] one guy who had seven dragons on the other side of the world, and a siege about to happen in this city and another 20 quests running. And, okay, this is what it's trying to do and it's having a hard time running that."
    All of which is fine, but Bethesda did little to correct that "misconception," asking affected players to send in their save files for analysis and with each patch addressing the issue causing save files to reduce in size.
    Howard also insisted: "We did a ton more testing this time around, so the game is definitely our most solid release regardless of platform." It's all relative, admittedly, but how many Skyrim players go through the game without a sprawling list of open quests dotted all over the map? It's the way the game is meant to be played so should it not, therefore, have been tested in the same way?
