Oh, it's on. Forget Battlefield vs. Modern Warfare 3: the biggest, ugliest fight in gaming's recent history is already kicking off - not on consoles, but in courtrooms.

A Los Angeles Superior Court judge this week ruled that there were enough facts to support allegations from former Infinity Ward chiefs Jason West and Vincent Zampella that Activision Blizzard defrauded the duo to the tune of $125 million - meaning the path is now set for a full trial later this year.

The pair are suing the US publisher, headed up by Bobby Kotick, for being fired before receiving what they claim were deserved royalty payments.

The duo claim that Activision promised them control of the Modern Warfare series - as well as increased royalties for Infinity ward on income over $50 million on future games. However, they say that they were removed in 2010 (forcibly, if you remember) before the due payment of over $125 million in royalties was to be made.

West and Zampella's attorneys will be able to question Activision Blizzard CEO Kotick directly as part of the case.

The news follows a ruling from back in March, when another L.A superior court judge ruled that Activision also had sufficient claims against Electronic Arts, for interfering with the duo's contract.

Judge Berle sided with Activision to pursue its countersuit litigation against EA, West and Zampella - a claim which will also now lead to a headline-grabbing mega-trial.

Activision is seeking $400 million in damages for "tortious interference, unfair competition, and breaches of fiduciary duty".

It claims that EA executives made secret attempts to lure the Call of Duty creators as early as July 2009 - pointing the finger at EA CEO John Riccitiello and Xbox founder Seamus Blackley in particular.

West and Zampella set up new studio Respawn Entertainment in April 2010. The US company is being funded by EA as part of the publisher's Partners programme.

No product has yet been revealed by Respawn. It is thought to have been creating a game since May 2010, whilst staff wearing the company's logo on their T-shirts were out en masse at E3.

Following West and Zampellla's removal from Infinity Ward, 46 staff left the Modern Warfare creator - 38 of whom have now declared that they have signed with Respawn.

In amongst a host of catty comments that have emerged on both sides of of the case, Activision has labelled the pair "self-serving schemers".

Activision in the dock: West and Zampella's claim for $125m unpaid royalties:
    First filed: March, 2010

    - Activision defrauded the founders of Infinity Ward by not releasing "substantial royalty payments"

    - Activision is also liable for for breach of contract, breach of the implied covenant of good faith and fair dealing, wrong termination in violation of public policy, and declaratory relief

    - West and Zampella's right to "control Modern Warfare-branded games" has been violated - and the duo want partial future control of the MW brand

EA, West and Zampella in the dock. Activision's claim for $400m in damages:
(First filed: April 2010. EA added to suit, December 2010)

    - EA execs began a conspiracy with West and Zampella whilst the duo were still Activision employees

    - Electronic Arts "intentionally interfered with contracts, engaged in unfair competition, and aiding and abetting breaches of fiduciary duty by West and Zampella"

    - West and Zampella refused to sign standard exit documents that testified they had returned all Activision property, including game development code

    - West and Zampella were "motivated by envy and personal greed" and intentionally released game trailers for Modern Warfare 2 on the same day that Treyarch posted promotion videos for Call of Duty: World at War DLC

The Brazilian site GameGeneration noticed a familiar logo on stage during a PlayStation Vita presentation at a Sony "Key Account Meeting" in São Paulo. Along with PSN, Wi-Fi, and DLNA, the Skype logo sits unassumingly to the side of the PlayStation Vita, suggesting that Skype will be available on the Vita as it was on the PSP.

Why would there be any doubt that a PSP feature would carry forward? Well, for one thing, between the PSP version and now, Skype was purchased by Sony's competitor Microsoft; for another, the PSP Go proved that we can't expect any feature to carry forward from one Sony handheld to another, not even playing PSP games.

When it acquired Skype, Microsoft said it planned to continue supporting versions on non-Microsoft platforms, so it's not impossible that it would continue supporting Sony handhelds. Right now, this is unconfirmed, as neither Microsoft or Sony offered comment when queried by Joystiq.

Crysis studio Crytek has denied reports that it's already developing for the Xbox 360's successor.

Earlier this week, a "high-ranking" insider claimed the developer was working on Timesplitters 4 for the new machine, which Microsoft would probably unveil at E3 2012.

However, today Crytek handed a statement to IGN denying any knowledge of a new system from Microsoft.

"Relating to the recent rumours, Crytek do not have any next generation hardware from Microsoft, nor do we know when Microsoft may announce future hardware or what that hardware will entail," it read.

The studio also took the opportunity to reassure gamers that the promised DirectX 11 update for the PC version of Crysis 2 is imminent.

"Crytek are working at pushing the boundaries of what current technology can bring, including our focus on DX11 which will be released shortly as an update for Crysis 2, and we believe this work, added to our estimations of what the new hardware will provide, set up CryENGINE as a next generation engine for all consoles."

Last month, a rumour did the rounds that EA is already working with next-gen Xbox dev kits, while earlier this week Avalanche Studios announced it was about to start developing a new IP for the next round of consoles.

    2. PS3 News

The PlayStation 3's successor is a very long way off, judging by comments from PlayStation US boss Jack Tretton.

Tretton told Forbes that the company is focussing heavily on the PlayStation 3 and Vita for the time being, and in any case, believes its current tech is still right on the cutting edge.

"PlayStation 3 is really just hitting its stride," he insisted. "And technologically, I don't think it's possible to provide any advancement beyond what we have."

"What we've seen from the competition is trying to add features that already exist in PlayStation 3," he said.

"We invested heavily in that, we rolled a very heavy rock up a steep hill, through the launch period. But now I think that all pays off, and we've got a long run way behind it. So, I wouldn't look for any discussion of a next generation PlayStation for quite some time."

Microsoft is rumoured to be readying a new machine for a 2013 launch, whereas Nintendo has the Wii U lined up for a 2012 release. It seems Tretton wasn't too impressed by the latter's recent E3 reveal.

"I think there's ground to be carved out for everybody. But I didn't see anything about Nintendo's announcement that said 'Oh, we'd better get working on rolling out a new PlayStation here pretty soon.'

"Our attitude is kind of 'welcome to the party.' If you're looking at being a multimedia entertainment device, if you're looking at high def gaming, that was 2006 for us."

Nintendo UK has shored up its online security in the wake of a "possible phishing threat".

After a comprehensive scan of its website, Nintendo has introduced "additional security measures" in a post declaring the whole site fully operational.

Nevertheless, Nintendo recommends users change their Club Nintendo passwords. Spot suspicious account activity? You'll need to contact your local Nintendo customer services centre.

Sections of the site - including the Club Nintendo user reward scheme - have been unavailable for the past week. They were "immediately shut down" as a preventative measure.

It's unclear what - if any - user details were threatened. Nintendo previously reassured gamers it "does not hold any bank, credit card or address details", so "this data is not at risk".

The resumption of service comes just in time for Legend of Zelda: Ocarina of Time 3D's launch. Register your copy quickly and Nintendo will send you a free soundtrack CD (while stocks last).
