    Android 1.5 and 1.6 are still major players in the field, together accounting for some 41 percent of all Google-powered phones in use as of July 15 -- but for the first time, Android 2.1 is on significantly more than half of the phones out there, up from an even 50 percent in mid-June. 55.5 percent of devices are running Eclair to be exact, and Froyo also makes an appearance with a little sliver of 3.3 percent -- an anemic figure obviously hampered by the fact that no one outside Google itself (on the now nearly-defunct Nexus One) has deployed the latest version yet. It's fascinating to see the change in the version mix over time get visualized like this -- now all we need is that dark green line at the very bottom to shoot upwards and obliterate everything else on the graph. Let's make it happen, guys.

    The Hague District Court has upheld a ruling on behalf of Nintendo against 11 retailers accused of the illegal selling of piracy chips and cartridges for the Wii and DS consoles.

    Retailers had been importing and selling the piracy aids in the Netherlands, and the court also rejected the retailers claims that Nintendo was engaging in unfair competition.

    "Nintendo welcomes the decision by the Hague District Court to uphold its claim that 11 online retailers operating in the Netherlands have acted unlawfully vis-à-vis Nintendo by importing and selling game copiers for use with Nintendo DS and mod chips for use with Nintendo Wii," said the company.

    "These devices circumvent Nintendo's technical measures designed to prevent software piracy. Nintendo also welcomes the decision by the Hague District Court to reject the online retailers' defence that Nintendo has engaged in acts of unfair competition."

    Nintendo said it was acting on behalf of all its development and publishing partners, as well as upholding the quality and standards associated with legitimate Nintendo products.

    "Nintendo protects its intellectual property rights globally and takes action to prevent the distribution of pirated software and devices that allow illegally downloaded software to be played.

    "Nintendo takes this action not only for the company's sake, but in the interests of its partners who spend time and money legitimately developing software for Nintendo videogame consoles and systems, and customers who expect the highest standards and integrity from products bearing the Nintendo name."

    The Xbox 360 Medal of Honor beta has finally begun.

    Head to the MOH website and log in to your EA account to redeem a beta key. When that key is redeemed you'll be given a token. That token can be used on Xbox Live to download the beta demo.

    It sounds like a key is given to anyone with an EA account.

    The Medal of Honor beta has been ongoing on PC and PS3 since earlier this summer. Dan Whitehead did some war for Eurogamer.

    Square Enix is remaking classic Japanese Super NES strategy game Tactics Ogre for the PSP.

    According to Famitsu magazine (thanks 1UP), the PSP version is called Tactics Ogre: Wheel of Fate. It'll retain the look of the original 1995 game, but be in 3D, enabling players to move the camera around for a better view of the battle field.

    While the gameplay will remain largely unchanged, the on-screen troop count is increased to 30 from 20, and there are new classes and new features for the skill system.

    Some of the original team have got together to work on the game, including director Hiroshi Minagawa, designer Yasumi Matsuno, character designers Akihiro Yoshida and Tsubasa Masao, and Hitoshi Sakimoto and Iwata Masaji on music.

    Matsuno is working on additions to the game's story and character elements, including new side stories.

    No release date is included in the report. Nor is word of a Western release. The original SNES game was never released outside of Japan, although a PlayStation port was later released in North America.

    Telltale Games is about to release the fourth episode of Sam & Max: The Devil's Playhouse on PlayStation Network.

    This one is titled Beyond the Alley of the Dolls and has something to do with canine clones and zombie apocalypses. We'll also get to find out more about who has been pulling the Freelance Police's strings.

    The episode is due to arrive on PSN later today. It's the last one before the season finale.

    Kinect requires six feet of space between the player and TV in order to be enjoyed.

    That's according to online retail behemoth Amazon, which has seemingly delivered the most concrete info yet on how close we can expect to wiggle in front our tellies.

    The retailer warns: "You'll need any Xbox 360 console, a Kinect sensor, Kinect games and 6 feet between you and your television for play space."

    The spacing info is mentioned on the game's pre-order page, but oddly not only the official Kinect checklist.

    If true, this pretty much puts bedroom Kinect gaming to bed, especially considering the device allegedly doesn't work when lying down either.

    EA has announced that Shank will be released on 24th August on PlayStation Network and 25th August on Xbox Live Arcade.

    The game will cost 1200 Microsoft Points on XBLA or $14.99 on PSN.

    Shank is made by developer Klei and caught Eurogamer's eye back at GDC.

    The idea's fairly standard: you're macho murderer in a 2D platform world, and you're going to cause a hell of a lot of carnage. The exciting part seems to be the execution, which is crisp, vibrant and powerful.
