Apple sued over 'misleading' Breaking Bad iTunes season pass

An Ohio man has sued Apple over its “deceptive and unfair sales practices” concerning the iTunes season pass for the TV show Breaking Bad.
Noam Lazebnik is arguing that the second half of the fifth season of Breaking Bad, which is airing a year after the first half, has been classified as a “different season” by Apple, “expecting individuals who had already purchased Season 5 to pony up another $22.99 [for HD] or $14.99 [for standard definition]”.
Lazebnik states in the lawsuit that Apple had misled the iTunes customers who purchased the Season 5 season pass, with Apple “evidently informing its customers who inquired that ‘Season 5’ would include all 16 episodes”, while the pass actually only granted access to the first eight episodes.
He then goes on to justify his stance by explaining that AMC, the production company that owns Breaking Bad, has previously stated that “the final season [of Breaking Bad] consists of 16 episodes”.
Lazebnik’s introduction to the class action complaint begins: “When a consumer buys a ticket to a football game, he does not have to leave at halftime. When a consumer buys an opera ticket, he does not get kicked out at intermission. When a consumer buys a ‘Season Pass’ to a full season of a television show on iTunes, that consumer should get access to the whole season.”
