blocked on WFC

I know we dont discuss "roms" here

But a friend of mine had "heard" (sigh all the rumors)
that if you run roms like mariokartds and connect to wfc to play you'll eventualy get banned cause nintendo figures it out . and not only banned from that specific game but your DS as a whole will get banned and unable to play any games wfc features.

Was wondering if anyone have any info on this subject, either for or against this being true
