if people use this iso loader then maybe a team working for sony could work out who was using it...

They need to get the Playstation downloading thing to work from psp, or maybe even from a computer, for faster download speeds.

The key thing is, that it is playing encrypted ISO's. Which means, it wouldn't natively load an unencrypted one, so no unencrypted code can get in.

The encryption will not matter. One of the features of 3.51 OE is to have a patched version that will load any images just like the patch for Popstation.
