Default Why is my Wlan Always on?

Can anyone please tell me why my wlan is ALWAYS on even when switch is in off position? never had problem till i installed cfw. Currently using 3.71 m33-2. Any help or links to a patch for this battery killing problem would be greatly appreciated. Thanks in advance.

Is it on even in the XMB?
Also on my PSP sometimes when the memory stick light is on the WLAN light appears on. Could this be it?
(also custom faceplates sometimes have badly positioned holes for the lights, maybe its just being lit up by the memory stick light).
