    Following a class action lawsuit against Microsoft regarding 'bricked' Xbox 360s - caused by the fall dashboard update - one of the lawyers involved in the case has said Microsoft's only defence would be "we're Microsoft, and we can do anything we want".

    Speaking to CVG brothers in arms Next-Gen.biz, Brian Kabateck, senior partner at Kabateck Brown Kellner said "I don't know what [Microsoft's] defence possibly could be. They screwed up, and there's no question that this [update problem] happened. How many people it happened to, we don't know, but my firm has been contacted by almost 400 people since this became public."

    The October 31 360 update caused problems for more than a few gamers, and a huge 76-page complaint thread can still be found on the Xbox.com forum. Many victims of the 'bricking' bug have contacted Microsoft, only to be told they will have to pay for the 360 repairs themselves.

    Some onlookers have criticised the legal action as lacking evidence, though according to Kabteck a blog post referring to the problem by Microsoft's own Harry 'Major Nelson' Hyrb could be used as evidence; "[Those posts] are an admission of the problem. ... They acknowledged this problem. [Microsoft] may have excuses for this, but they acknowledged this problem.

    Luckily for us, our Xbox 360s are still working fine.

    Funcom announced that 'Age of Conan' has been approved by Microsoft for the Xbox 360. The announcement means that Funcom can start official development of an Xbox 360 version of the game.


    "This is a groundbreaking leap forward for Funcom. The fact that we now get the chance to develop 'Age of Conan' for the Xbox 360 means access to a potentially whole new and large MMO market," said Trond Arne Aas, CEO of Funcom. "The fast-paced and innovative combat system in 'Age of Conan' will suit the demanding console audience perfect. We believe the amazing online capabilities of Xbox 360 will be a great match for MMOs like 'Age of Conan', and as one of a handful officially approved MMO games for the console we aim to create a unique, brutal and powerful online gaming experience."

    The Windows version of 'Age of Conan: Hyborian Adventures' is a Showcase title for Windows Vista, and the game won 'Best MMO of E3' awards from IGN, GameSpot, GameSpy and Yahoo. The game was a runner-up to the 'Most Innovative Game of Show' E3 award from Gamespot, and PC Gamer US named it as one of their top 10 most anticipated PC games.

    More than 100,000 units shifted during opening weekend

    Nintendo and Chart Track have confirmed to GamesIndustry.biz that the Wii has become the fastest-selling home console ever, with 105,000 systems already sold.

    Last week, Nintendo announced that consumers snapped up 50,000 Wii units within 12 hours of the console going on sale.

    The tills continued to ring over the next two days, making the Wii the first console to sell more than 100,000 units during its opening weekend.

    In contrast, the GameCube saw sales of 52,000 consoles in the first weekend after launch, while the figure for Xbox 360 stood at 70,000 units.

    Of the 14 software titles launching with the Wii, six made it into the all-formats top 40 - including Zelda, which debuted at number 5. Other popular titles included Wii Play and Ubisoft's Red Steel.

    It was also a great week for Nintendo's handheld, with around 110,000 DS units sold, and 14 games in the top 40.

    Rob Enderle the Principal Analyst in the Enderle Group, has posted an article at tomshardware.co.uk, about the HD DVD/Blue-ray war:


    Much like it is with game systems; competing formats for video are not about the best technology. They are about the most prevalent technology. It is expensive to publish movies and, at least for now, you can't put Blu-ray and HD DVD disks into the same box.

    With the Xbox 360 moving so strongly into the market and the top accessory this year being the $200 HD-DVD drive the battle may be over by year end. There is every chance that there may be as many as ten times more HD DVD players than Blu-ray players in the market by the end of the year - even if you don't factor in that HP, the current leader in PC sales, started shipping desktop computers with a $100 HD DVD option. This, coupled with a much lower overall cost for the stand alone players as well as better support for legacy TVs and dual mode disks (that have both legacy DVD and HD-DVD content on a single disk), suggests that HD-DVD is now the format to beat.

    HD-DVD wins because of the Xbox 360 - which is ironic, given Blu-ray should have won because of the Playstation 3. Instead, Blu-ray has delayed the Playstation 3 to a point where Sony may have to wait until the Playstation 4 to recover.

    BetaMax, Mini-Disk, MemoryStick, and now Blu-ray. At least Sony is consistent. Also, if there is one company that is really looking forward to a better 2007 more than Sony I don't know of it. Boy, when you couple in root kits and battery/camera recalls, you are talking about a really nasty run of bad luck for Sony this year.

    This demo requires firmware 3.02.

    To install once you have downloaded. Go to the PSP/GAME folder then Create a folder called "NPJG90001" and place the EBOOT.PBP file in that folder.

    whats new:

    You can use the headphone remote to steer the snake, as well as the analog (dont use both though as the headphone remote is rigged to act like the analog stick). Rewind steers left, Forward steers right. Play/Pause will *exit* the game, so be careful pressing down on the remote (I did that intentionally for debugging)

    You all asked for it and you got it: the snake will wrap around the screen edges now. If it leaves left edge, it reappears on right side..rinse and repeat for the other edges. Kudos to Shine in #pspdev for code to do this.

    And a new pickup item: the booster. It'll show up as a blue item with 1-8 circles on it. This will add +1 to +8 on the score multiplier, but will also increase the speed of the snake per each +.

    No menu yet, it'll be up in next release. Till then...enjoy

    Story
    A routine shuttle mission by the International Space Agency has encountered catastrophe!

    Gameplay

    We (still) have a Wii problem despite stronger controller straps as once again we're reminded that common sense does not come standard when playing Wii. Just read the below account as one guy gets hopped-up on liquid courage and allegedly nails his girlfriend in the eye while playing Zelda resulting in the purple growth monstrosity you see above. Amazingly, it was followed by a smile instead of a night on the sofa.

    In the boyfriend's own words: "After guzzling a copious amount of 'wife beater' (Stella Artois), I returned home to find the girlie in mid battle with a Zelda 'Boss'. In my inebriated state, it was instinctual to become her knight in shining armour. I proceeded to take the controllers off her and fight the beast myself. Unfortunately, my courage was far greater than my skill. Having taken a good kicking, Liz then tried to intervene with disastrous results. She approached me from the side, appearing from my blind spot, whilst I was performing a slashing movement. I hit her with full force right in her eye!"

    For reals? Possibly, but if the dude wasn't swinging the remote with his left hand hitting her in the right eye, someone has some explaining to do.
